Em todo filme policial americano, a gente ouve aquela advertência padrão que os policiais são obrigados a dar aos presos, “Você tem direito a ficar calado. Tudo o que você disser poderá ser usado contra você na corte. Você tem direito a um advogado e se não puder pagar, o Estado lhe indicará um defensor.” É a Advertência Miranda, obrigatória para evitar alegações de nulidade posteriores.
Vi na Apple TV+, o filme MIRANDA’S VICTIM, dirigido pela cineasta Michelle Danner. O filme conta a origem da obrigatoriedade da advertência.
Em 1963, Trish Weir (Abigail Breslin, a MISS SUNSHINE) uma jovem de 18 anos foi raptada e estuprada por um sujeito chamado Ernesto Miranda (Sebastian Queen). Preso, ele foi reconhecido pela vítima e fez uma confissão de próprio punho.
Anos depois, com Miranda na prisão, um advogado criminalista chamado John Flynn (Ryan Phillipe) recorreu à Suprema Corte dos EUA, alegando cerceamento de defesa, porque seu cliente não sabi aue podia pedir a presença de um advogado. A sentença foi anulada.
A partie desse caso, a advertência Miranda ficou obrigatória em todos os EUA.

Além de tudo, conta com ótimo elenco: Donald Sutherland, Andy Garcia, Mireille Enos, Luke Wilson, Emily VanCamp, Kyle MacLachlan e Nolan Gould.
MIRANDA’S VICTIM merece ser visto. É um belo drama legal.

You have the right to an attorney and If you cannot pay, the State will appoint you a defender.” It is the Miranda Warning, mandatory to avoid subsequent invalidity claims.
I saw the film MIRANDA’S VICTIM on Apple TV+, directed by filmmaker Michelle Danner. The film tells the origin of the mandatory warning.

Years later, with Miranda in prison, a criminal lawyer named John Flynn (Ryan Phillipe) appealed to the US Supreme Court, alleging a defense restriction, because his client did not know that he could request the presence of a lawyer. The sentence was overturned.
From this case onwards, the Miranda warning became mandatory throughout the USA.

MIRANDA’S VICTIM deserves to be seen. It’s a beautiful and powerful legal drama.
